Kiralad\u0131\u011f\u0131 evden ba\u015fka ta\u015f\u0131nmaz\u0131 olmad\u0131\u011f\u0131n\u0131 gerek\u00e7e g\u00f6stererek kirac\u0131s\u0131na 20 Kas\u0131m 2023\u2019te bir ihtarname g\u00f6nderdi ve evi bo\u015faltmas\u0131n\u0131 istedi.<\/p>\n<p>Kirac\u0131 evi tahliye etmeyince \u00f6nce taraflar arabulucuya gitti, burada da anla\u015famay\u0131nca mal sahibi bo\u015fanma a\u015famas\u0131nda oldu\u011fu ve kirac\u0131s\u0131n\u0131n bulundu\u011fu konuttan ba\u015fka m\u00fclk\u00fcn\u00fcn olmad\u0131\u011f\u0131n\u0131 gerek\u00e7e g\u00f6stererek 10 \u015eubat 2024\u2019te ihtiya\u00e7 sebebiyle tahliye davas\u0131 a\u00e7t\u0131. Tapu kay\u0131tlar\u0131n\u0131 inceleyen mahkemeden dikkat \u00e7eken bir karar \u00e7\u0131kt\u0131.<\/p>\n<p><strong>EV SAH\u0130B\u0130 \u2018\u0130HT\u0130YACIM VAR\u2019 DED\u0130, K\u0130RACIYI \u00c7IKARMAK \u0130STED\u0130 <\/strong><\/p>\n<p>Ev sahibi ile kirac\u0131 aras\u0131nda ya\u015fanan dava s\u00fcrecini milliyet.com.tr\u2019ye a\u00e7\u0131klayan Avukat Gizem Gonce \u015fu ifadeleri kulland\u0131: \u201cM\u00fclk sahibi, 9 \u015eubat 2020 tarihinde Etiler\u2019deki dairesini 1.150 TL\u2019ye kiraya verdi. Ev sahibi bu s\u00fcre\u00e7te kendisi de kirada oturmaktayd\u0131. <\/p>\n<p>Halihaz\u0131rda bo\u015fanma s\u00fcrecinde olan ev sahibinin konut ihtiyac\u0131 ortaya \u00e7\u0131k\u0131nca, kirac\u0131s\u0131na ihtarname g\u00f6nderildi. Ancak, kirac\u0131 s\u00fcresinde evi tahliye etmeyerek dava s\u00fcrecini ba\u015flatt\u0131. Yap\u0131lan yarg\u0131lama sonunda, ev sahibi ve bo\u015fanma durumu g\u00f6z \u00f6n\u00fcnde bulundurularak \u00f6nemli bir karara imza at\u0131ld\u0131. <\/p>\n<p><strong>\u0130HTARNAME G\u00d6NDER\u0130LD\u0130, K\u0130RACI EVDEN \u00c7IKMADI <\/strong><\/p>\n<p>Ev sahibi bo\u015fanma s\u00fcrecindeki e\u015finden ayr\u0131 ya\u015famak zorunda kal\u0131nca, kiralad\u0131\u011f\u0131 eve ihtiyac\u0131 oldu\u011funu belirtti. Bunun \u00fczerine 20 Kas\u0131m 2023 tarihinde kirac\u0131s\u0131na evin tahliye edilmesi i\u00e7in 3 ay \u00f6nceden bir ihtarname g\u00f6nderildi. Ancak, kirac\u0131 bu ihtarnameye cevap vermeyerek, 10 \u015eubat 2024&#8217;te evi tahliye etmedi.<\/p>\n<p>Ev sahibi, ara buluculuk s\u00fcrecine gitse de herhangi bir anla\u015fmaya var\u0131lamad\u0131. Bunun \u00fczerine, ev sahibinin konut ihtiyac\u0131 gerek\u00e7e g\u00f6sterilerek 10 \u015eubat 2024\u2019te ihtiya\u00e7 sebebiyle tahliye davas\u0131 a\u00e7\u0131ld\u0131. Bu s\u0131rada evin kira bedeli 9.500 TL olmu\u015ftu.<\/p>\n<p><strong>K\u0130RACI: EV SAH\u0130B\u0130N\u0130N ASIL AMACI K\u0130RANIN Y\u00dcKSELMES\u0130 <\/strong><\/p>\n<p>Kirac\u0131 cevap dilek\u00e7esinde davan\u0131n s\u00fcresinde a\u00e7\u0131lmad\u0131\u011f\u0131n\u0131, usulden reddedilmesi gerekti\u011fini ve ev sahibinin konut ihtiyac\u0131n\u0131n samimi olmad\u0131\u011f\u0131n\u0131, as\u0131l gayesinin d\u00fc\u015f\u00fck kalan kira getirisinin y\u00fckselmesi oldu\u011funu ve bu sebeple davan\u0131n reddine karar verilmesini talep etti.<\/p>\n<p><strong>TAPUYU SORGULAYAN MAHKEMEDEN KARAR <\/strong><\/p>\n<p>Mahkeme yap\u0131lan incelemede mal sahibinin e\u015fi ile bo\u015fanma a\u015famas\u0131nda oldu\u011funu ve ayr\u0131 ya\u015famak iste\u011finin beyan edildi\u011fini, Tapu ve Kadastro Bilgi Sistemi (TAKB\u0130S) sorgulamas\u0131na g\u00f6re ev sahibinin e\u015finin \u00fczerine kay\u0131tl\u0131 bir ta\u015f\u0131nmaz oldu\u011fu, bundan dolay\u0131 da ba\u015fka bir ta\u015f\u0131nmaz\u0131n\u0131n olmad\u0131\u011f\u0131 tespit edilerek a\u00e7\u0131lan davan\u0131n ger\u00e7ek, samimi ve zorunlu oldu\u011fu ispatlanarak kabul\u00fcne karar verdi. <\/p>\n<p>Kirac\u0131 taraf, davan\u0131n usulden reddedilmesi gerekti\u011fini savunsa da yap\u0131lan yarg\u0131lama sonucunda, ev sahibinin ihtiyac\u0131n\u0131n ger\u00e7ek ve samimi oldu\u011fu kabul edildi. <br \/>Mahkeme, kirac\u0131n\u0131n evden tahliye edilmesi y\u00f6n\u00fcnde karar verdi. T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 350. maddesi gere\u011fi, ev sahibinin konut ihtiyac\u0131n\u0131n ger\u00e7ek ve zorunlu oldu\u011funa kanaat getirildi. Ayr\u0131ca, dava s\u00fcresinin yasal s\u00fcre i\u00e7inde a\u00e7\u0131ld\u0131\u011f\u0131 ve ihtiyac\u0131n s\u00fcreklili\u011fi kan\u0131tlanarak 20 Aral\u0131k 2025\u2019te davan\u0131n kabul\u00fcne karar verildi.<\/p>\n<p><strong>VEKALET \u00dcCRET\u0130 VE YARGILAMA G\u0130DER\u0130 K\u0130RACIYA Y\u00dcKLEND\u0130 <\/strong><\/p>\n<p>Kirac\u0131n\u0131n 18 bin TL vekalet \u00fccreti ve 1,171,60 TL yarg\u0131lama giderini \u00f6demesine karar verildi. Mahkeme, tahliye karar\u0131n\u0131n uygulanmas\u0131 gerekti\u011fini vurgulad\u0131.<\/p>\n<p><strong>\u2018TAH\u0130YEDE \u0130HT\u0130YA\u00c7 SAM\u0130M\u0130 VE GER\u00c7EK OLMALI\u2019 <\/strong><\/p>\n<p>Ev sahiplerinin, ihtiya\u00e7 nedeniyle kirac\u0131y\u0131 tahliye etme haklar\u0131, kira s\u00f6zle\u015fmesinin biti\u015f tarihinden itibaren bir ay i\u00e7erisinde ba\u015flat\u0131lmal\u0131d\u0131r.
