G\u00fcncel siyasi tart\u0131\u015fmalar\u0131n bile bir \u015fekilde g\u00f6t\u00fcr\u00fcl\u00fcp dayand\u0131r\u0131ld\u0131\u011f\u0131 bu d\u00f6nem, kendisinden sonra gelen her \u015feyi etkilemi\u015ftir.<\/p>\n<div>\n<div><img decoding=\"async\" src=\"https:\/\/kamucalisani.net\/wp-content\/uploads\/2026\/02\/osmanli-sekuler-hukukla-tanisiyor-0-Ajdgi2GD.jpg\"\/><\/img><\/div>\n<\/div>\n<p>Tanzimat D\u00f6nemi, somut olarak 3 Kas\u0131m 1839\u2019da, Abd\u00fclmecid devrinde il\u00e2n edilen, Tanzimat Ferman\u0131 da denilen G\u00fclhane Hatt-\u0131 H\u00fcm\u00e2yunu ile ba\u015flar. Bu esasen, h\u00fck\u00fcmetin izleyece\u011fi yolu ve dolay\u0131s\u0131 ile reformlar\u0131 ifade eden bir belgedir. Erik Jan Z\u00fcrcher, vadedilen reformlar\u0131n, dizinin ilk b\u00f6l\u00fcm\u00fcnde yer alan II. Mahmud\u2019un politikalar\u0131n\u0131n devam\u0131 oldu\u011funu belirtir. Bu metnin haz\u0131rlanmas\u0131nda en b\u00fcy\u00fck pay sahibi de Sadrazam Mustafa Re\u015fid Pa\u015fa\u2019d\u0131r.<\/p>\n<p>Z\u00fcrcher, s\u00f6z konusu metindeki d\u00f6rt temel reformu a\u00e7\u0131klarken \u201cpadi\u015fah\u0131n tebaas\u0131n\u0131n can, namus ve mal\u0131n\u0131n g\u00fcvence alt\u0131na al\u0131nmas\u0131\u201d maddesinin, Avrupa\u2019da bulunmu\u015f ve yabanc\u0131 dil bilen devlet adamlar\u0131n\u0131n klasik liberal d\u00fc\u015f\u00fcnceyi tekrar etmesi ve b\u00fcrokratlar\u0131n \u201cpadi\u015fah\u0131n kullar\u0131 olarak tehlikeye a\u00e7\u0131k konumlar\u0131ndan kurtulma arzusu\u201d oldu\u011funu vurgular. Yine Z\u00fcrcher, metinde yer alan \u201cOsmanl\u0131 Hristiyanlar\u0131na e\u015fit haklar vaadinin k\u0131smen yabanc\u0131lar\u0131 etkilemek i\u00e7in yap\u0131ld\u0131\u011f\u0131n\u0131\u201d belirtir. Di\u011fer maddelerse vergilendirme ve zorunlu askerlikle ilgilidir. Belge d\u00f6nem i\u00e7in bir simgeye d\u00f6n\u00fc\u015fm\u00fc\u015f olsa da asl\u0131nda d\u00f6nem boyunca yap\u0131lan reformlar, bunlar\u0131n \u00f6tesindedir.<\/p>\n<p><strong>Parlamenter usul<\/strong><\/p>\n<p>Bu d\u00f6nemde yasalar konusunda \u00e7al\u0131\u015fmalar y\u00fcr\u00fcten dan\u0131\u015fma meclisleri geli\u015ftirildi. Burada bu meclislerden Meclis-i V\u00e2l\u00e2-y\u0131 Ahk\u00e2m-\u0131 Adliye\u2019nin ismini anmakta fayda var. Z\u00fcrcher, bu dan\u0131\u015fma meclisinde kararlar\u0131n \u00e7o\u011funluk oyuyla al\u0131nd\u0131\u011f\u0131n\u0131 ve padi\u015fah\u0131n bu kararlar\u0131 onaylama s\u00f6z\u00fc verdi\u011fini belirterek, bunun \u201cbir \u00e7e\u015fit parlamenter usul\u201d getirdi\u011fini belirtir. Ama elbette bu meclis, se\u00e7im yoluyla olu\u015fmam\u0131\u015ft\u0131.<\/p>\n<p><strong>Sek\u00fcler yasalar<\/strong><\/p>\n<p>Tanzimat D\u00f6nemi\u2019nde hukuk alan\u0131nda \u00f6nemli ad\u0131mlar at\u0131ld\u0131, Bat\u0131\u2019dan baz\u0131 mevzuatlar al\u0131nd\u0131. Prof. Dr. Zafer Toprak, sek\u00fcler hukuka ge\u00e7i\u015fin ticaret, ceza ve uluslararas\u0131 hukuk alanlar\u0131nda ba\u015flad\u0131\u011f\u0131n\u0131, bu alanlarda Bat\u0131\u2019dan do\u011frudan \u201cal\u0131nt\u0131\u201d yap\u0131ld\u0131\u011f\u0131n\u0131 ancak \u00f6zel hukuk alan\u0131nda Bat\u0131 ile araya mesafe konuldu\u011funu kaydeder: \u201c\u0130slami esaslara g\u00f6re k\u0131smi nitelikte bir t\u00fcr medeni kanun olan Mecelle haz\u0131rland\u0131.\u201d Toprak\u2019a g\u00f6re 1850 tarihli Kanunname-i Ticaret, \u0130slam hukukuyla ba\u011fda\u015fm\u0131yordu, \u00f6rne\u011fin faize cevaz veriliyordu. Ceza kanunnameleri de hi\u00e7bir direni\u015fle kar\u015f\u0131la\u015fm\u0131yordu. Sadece medeni hukuk s\u00f6z konusu oldu\u011funda muhalefet g\u00f6r\u00fcl\u00fcyordu. Bu d\u00f6nemde Frans\u0131z Medeni Kanunu\u2019nun da terc\u00fcme edildi\u011fini, kabul\u00fc i\u00e7in \u00e7aba g\u00f6sterildi\u011fini belirten Toprak, muhafazak\u00e2r \u00e7evrelerin a\u011f\u0131rl\u0131\u011f\u0131yla bunun rafa kald\u0131r\u0131ld\u0131\u011f\u0131n\u0131 anlat\u0131r.<\/p>\n<div>\n<div><img decoding=\"async\" src=\"https:\/\/kamucalisani.net\/wp-content\/uploads\/2026\/02\/osmanli-sekuler-hukukla-tanisiyor-1-BRp1cUUD.jpg\"\/><\/img><\/div>\n<\/div>\n<p>Z\u00fcrcher de bu d\u00f6nemde \u015feriat\u0131n hi\u00e7bir zaman y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lmad\u0131\u011f\u0131n\u0131 ama faaliyet alan\u0131n\u0131n hemen tamam\u0131yla aile hukukuyla s\u0131n\u0131rland\u0131r\u0131ld\u0131\u011f\u0131n\u0131, m\u00fclkiyet sorunlar\u0131n\u0131n da laik hukuka havale edildi\u011fini s\u00f6yler. Zafer Toprak, sek\u00fcler hukuka y\u00f6nelik mahkemelerin kurulma \u00e7abalar\u0131n\u0131n da bu d\u00f6nemde ba\u015flad\u0131\u011f\u0131n\u0131 belirtir: \u201cYeni d\u00fczenlenen ve Bat\u0131\u2019dan esinlenen mahkemelere nizamiye mahkemeleri dendi. Bat\u0131\u2019dan al\u0131nan Ceza Kanunnamesi\u2019ni uygulamak \u00fczere \u0130stanbul\u2019da ceza mahkemesi niteli\u011finde Meclis-i Tahkikat kuruldu.\u201d<\/p>\n<p><strong>R\u00fc\u015fdiyeler, idadiler, M\u00fclkiye, Mekteb-i Sultani&#8230;<\/strong><\/p>\n<p>Osmanl\u0131 idarecileri, de\u011fi\u015fim i\u00e7in en \u00f6nemli kurumlar\u0131n okullar oldu\u011funun fark\u0131ndayd\u0131. \u0130stedikleri de\u011fi\u015fime ayak uyduracak, hatta buna \u00f6nc\u00fc olacak nesillerin yeti\u015fmesi i\u00e7in II. Mahmud d\u00f6neminden itibaren okullar a\u00e7\u0131lmaya ba\u015flanm\u0131\u015ft\u0131. Tanzimat D\u00f6nemi\u2019nde de bu durum devam etti. 1859 y\u0131l\u0131nda modernle\u015fme hareketlerinin, Bat\u0131l\u0131la\u015fman\u0131n bir sonucu olarak kurulan M\u00fclkiye\u2019nin amac\u0131 do\u011frudan bu ama\u00e7lar etraf\u0131nda idareciler yeti\u015ftirmekti. Osmanl\u0131\u2019dan Cumhuriyet\u2019e kurumsal bir devaml\u0131l\u0131k \u00f6rne\u011fi olarak da bug\u00fcn Ankara Siyasal ad\u0131yla varl\u0131\u011f\u0131n\u0131 s\u00fcrd\u00fcr\u00fcr. Dini a\u011f\u0131rl\u0131kl\u0131 geleneksel e\u011fitim kurumlar\u0131n\u0131n d\u0131\u015f\u0131nda Bat\u0131l\u0131 tarzda orta\u00f6\u011fretim kurumu olarak a\u00e7\u0131lan r\u00fc\u015fdiyelerin temelleri de II. Mahmud d\u00f6neminde at\u0131lm\u0131\u015ft\u0131. 1847\u2019de de tam olarak hayata ge\u00e7ti. K\u0131zlar i\u00e7in de ilk r\u00fc\u015fdiye mektebi 1858\u2019de kuruldu. R\u00fc\u015fdiyelerin ard\u0131ndan liseye denk olan idadiler a\u00e7\u0131ld\u0131. Bu okullar da askeri ve sivil olarak ikiye ayr\u0131l\u0131yordu. Bir\u00e7ok \u00f6nemli ismin yeti\u015fece\u011fi Galatasaray Lisesi de Mekteb-i Sultani ismiyle 1868 y\u0131l\u0131nda e\u011fitime ba\u015flad\u0131.<\/p>\n<p><strong>De\u011fi\u015fen k\u00fclt\u00fcr\u00fcn edebiyattaki izleri<\/strong><\/p>\n<p>Edebiyat, Tanzimat\u2019la gelen yeni durumu yans\u0131tmas\u0131 a\u00e7\u0131s\u0131ndan \u00f6nemli ve i\u015flevsel bir alan. Bat\u0131\u2019dan gerek \u00e7eviri arac\u0131l\u0131\u011f\u0131yla gelen eserler, gerekse roman gibi Bat\u0131\u2019ya ait yeni t\u00fcrlerin Osmanl\u0131 yazarlar\u0131 taraf\u0131ndan kaleme al\u0131nmas\u0131, bu d\u00f6nemde Bat\u0131\u2019n\u0131n k\u00fclt\u00fcrel alandaki etkisini g\u00f6sterir. \u201cDivan \u015fiiri\u201d denilen klasik \u015fiir de yava\u015f yava\u015f geride kal\u0131r. Bunlar yaln\u0131zca edebiyattaki basit de\u011fi\u015fimler de\u011fil, y\u00fczlerce y\u0131ll\u0131k bir k\u00fclt\u00fcr\u00fcn yerini yeni bir k\u00fclt\u00fcre b\u0131rakt\u0131\u011f\u0131n\u0131n i\u015faretleridir.<\/p>\n<div>\n<div><img decoding=\"async\" src=\"https:\/\/kamucalisani.net\/wp-content\/uploads\/2026\/02\/osmanli-sekuler-hukukla-tanisiyor-2-FiHSL7EC.jpg\"\/><\/img><\/div>\n<\/div>\n<p><strong>Gazete fakt\u00f6r\u00fc<\/strong><\/p>\n<p>Gazete de yine bu d\u00f6nemin \u00f6nemli ara\u00e7lar\u0131ndan, Bat\u0131l\u0131la\u015fman\u0131n simgelerinden biri. Fikirlerin yay\u0131lmas\u0131ndaki i\u015flevinin yan\u0131 s\u0131ra Bat\u0131\u2019dan al\u0131nan yeni edebiyat t\u00fcrleri de asl\u0131nda \u00f6nce gazetede ortaya \u00e7\u0131km\u0131\u015ft\u0131r. Romanlar, kitap olarak yay\u0131mlanmadan \u00f6nce gazetelerde tefrika edilmi\u015ftir.<\/p>\n<p><strong>Neden roman?<\/strong><\/p>\n<p>T\u00fcrk\u00e7ede roman\u0131n bu d\u00f6nemde ortaya \u00e7\u0131kmas\u0131 elbette bir tesad\u00fcf de\u011fildir. Bat\u0131\u2019ya ait toplumsal ve ekonomik dinamiklerin, k\u0131saca modernle\u015fmenin bir \u00fcr\u00fcn\u00fc olan roman, Osmanl\u0131\u2019da da modernle\u015fmeyle birlikte ortaya \u00e7\u0131kar. Zira roman\u0131n merkezinde \u201cbirey\u201d ve onun i\u00e7 d\u00fcnyas\u0131 vard\u0131r. Lise edebiyat derslerinin de\u011fi\u015fmez ezberi \u201cBat\u0131 tarz\u0131nda ilk roman\u201d s\u0131fat\u0131n\u0131 Mai ve Siyah\u2019a kazand\u0131ran da bu farkt\u0131r.<\/p>\n<p>Bu d\u00f6nemde edebiyat eserleri toplumsal d\u00f6n\u00fc\u015f\u00fcmle ilgilidir: \u015eemseddin Sami, Taa\u015f\u015fuk-\u0131 Talat ve Fitnat\u2019ta geleneksel kad\u0131n-erkek ili\u015fkisini, toplumda kad\u0131na bak\u0131\u015f\u0131 ve g\u00f6r\u00fcc\u00fc usul\u00fc evlili\u011fi ele\u015ftirir; \u015einasi, \u015eair Evlenmesi\u2019nde yine g\u00f6r\u00fcc\u00fc usul\u00fc evlili\u011fin nas\u0131l sak\u0131ncal\u0131 olabildi\u011fini anlat\u0131r; Recaizade Mahmud Ekrem Araba Sevdas\u0131\u2019nda \u201cyanl\u0131\u015f Bat\u0131l\u0131la\u015fm\u0131\u015f\u201d tipleri tenkit eder. Edebiyat, toplumun nas\u0131l de\u011fi\u015fmesi gerekti\u011fi y\u00f6n\u00fcnde mesajlar\u0131n verildi\u011fi bir \u201ce\u011fitim alan\u0131\u201d gibidir.<\/p>\n<p><strong>\u0130kilemin yans\u0131mas\u0131<\/strong><\/p>\n<p>Tanzimat edebiyat\u0131 genel olarak \u201cikili kar\u015f\u0131tl\u0131klar\u201d \u00fczerinden okunur. Bu ikililerden biri de \u015f\u00fcphesiz \u201cDo\u011fu\u201d ve \u201cBat\u0131\u201dd\u0131r. Cumhuriyet d\u00f6neminin Osmanl\u0131\u2019dan bir kopu\u015f olup olmad\u0131\u011f\u0131 ile ilgili tart\u0131\u015fma olduk\u00e7a eski olmakla birlikte Cumhuriyet\u2019in kurucu kadrosunun Osmanl\u0131 son d\u00f6neminde, modernle\u015fme dolay\u0131s\u0131yla olu\u015fan de\u011fi\u015fim ortam\u0131nda yeti\u015fti\u011fi de g\u00f6z ard\u0131 edilmemelidir. Osmanl\u0131 subaylar\u0131, entelekt\u00fcelleri, gazetecileri ve siyaset\u00e7ileri, Cumhuriyet d\u00f6neminde ink\u0131lap\u00e7\u0131 anlay\u0131\u015f\u0131 yeni formlarla hayata ge\u00e7irmeye \u00e7al\u0131\u015fm\u0131\u015flard\u0131r. Cumhuriyet, ilk d\u00f6nemde Osmanl\u0131 ge\u00e7mi\u015fi ile aras\u0131na bir mesafe koyma iddias\u0131na sahip olsa bile tarihsel ve sosyolojik s\u00fcreklilik ink\u00e2r edilemeyecek bir ger\u00e7ekliktir. Elbette Cumhuriyet d\u00f6neminin Osmanl\u0131 modernle\u015fmesinden ayr\u0131lan kendine \u00f6zg\u00fc y\u00f6nleri de bulunmaktad\u0131r. \u00d6rne\u011fin Cumhuriyet\u2019in ulus devlet s\u0131n\u0131rl\u0131l\u0131\u011f\u0131 ve ger\u00e7ekli\u011fi \u00f6nemli bir farka i\u015faret eder.\u201d<\/p>\n<p>\u25a0 II. Mahmud, mehter tak\u0131m\u0131 yerine Bat\u0131l\u0131 tarzdaki Muz\u0131ka-i H\u00fcm\u00e2y\u00fbn\u2019u kurdu. Ba\u015f\u0131na \u0130talyan askeri bando \u015fefi Giuseppe Donizetti getirildi. Donizetti, 1829 y\u0131l\u0131nda II. Mahmud\u2019a ithafen \u201cMahmudiye\u201d mar\u015f\u0131n\u0131 besteledi.<\/p>\n<p>\u25a0 I. Abd\u00fclmecid, Bat\u0131 m\u00fczi\u011fiyle b\u00fcy\u00fcd\u00fc, operay\u0131 severdi. Haremde kad\u0131nlar orkestra \u00e7al\u0131\u015fmalar\u0131 yap\u0131yor, piyano dersleri al\u0131yordu. Donizetti\u2019nin 1839\u2019da Abd\u00fclmecid i\u00e7in besteledi\u011fi \u201cMecidiye Mar\u015f\u0131\u201d, milli mar\u015f olarak kullan\u0131ld\u0131.<\/p>\n<p>\u25a0 Piyano eserleri besteleyen Abd\u00fclaziz, Avrupa ziyaretleri s\u0131ras\u0131nda opera ve baleler izledi.<\/p>\n<p>\u25a0 V. Murad, iyi derecede piyano \u00e7al\u0131yor\u00a0ve Bat\u0131 m\u00fczi\u011fi besteleri yap\u0131yordu.<\/p>\n<p>\u25a0 II.
