Aradan ge\u00e7en 1 y\u0131ll\u0131k s\u00fcre sonras\u0131nda kirac\u0131 belirlenen tarihte evi tahliye etmeyince ev sahibi icra takibi ba\u015flatt\u0131.\u00a0<\/p>\n<p>\u0130ngiliz kirac\u0131, \u2018T\u00fcrk\u00e7e bilmiyorum, taahh\u00fctname hileli\u2019 diyerek icra takibine itiraz etti ve takip durdu. Bunun \u00fczerine ev sahibi 11.04.2023 tarihinde itiraz\u0131n iptali davas\u0131 a\u00e7t\u0131. Bu s\u0131rada evin kira bedeli 60 bin TL olmu\u015ftu.\u00a0<\/p>\n<p><strong>YEREL MAHKEMEDEN TAHL\u0130YE KARARI GELD\u0130, K\u0130RACI \u0130T\u0130RAZ ETT\u0130\u00a0<\/strong><\/p>\n<p>Yerel mahkeme yap\u0131lan t\u00fcm tebligatlar\u0131n do\u011fru oldu\u011funu, herhangi bir ayk\u0131r\u0131l\u0131k bulunmad\u0131\u011f\u0131n\u0131 beyan etti ve kirac\u0131n\u0131n tahliyesine karar verdi. Tahliye karar\u0131na kirac\u0131 itiraz etti ve yarg\u0131lama istinaf mahkemesine ta\u015f\u0131nd\u0131. \u0130stinaf mahkemesinden dikkat \u00e7eken bir karar \u00e7\u0131kt\u0131.<\/p>\n<p>Ev sahibi ile kirac\u0131 aras\u0131nda ya\u015fananlar\u0131 milliyet.com.tr\u2019ye a\u00e7\u0131klayan Avukat Gizem Gonce \u015fu ifadeleri kulland\u0131: \u201c\u0130stanbul\u2019un Etiler semtinde mal sahibi \u0130ngiliz bir ki\u015fiye evini kiraya verdi. Yabanc\u0131 olmas\u0131 sebebiyle tahliye taahh\u00fctnamesi de noter huzurunda ve terc\u00fcman e\u015fli\u011finde yap\u0131ld\u0131.<\/p>\n<p><strong>\u0130NG\u0130L\u0130Z K\u0130RACI EV\u0130 TAHL\u0130YE ETMED\u0130, \u0130CRA TAK\u0130B\u0130 BA\u015eLATILDI\u00a0<\/strong><\/p>\n<p>Ev sahibi sonras\u0131nda kirac\u0131n\u0131n \u0130stanbul Noterli\u011fi taraf\u0131ndan 04.11.2021 tarihinde tahliye taahh\u00fctnamesi verdi\u011fini, ancak taahh\u00fctname gere\u011fince kiralanan ta\u015f\u0131nmaz\u0131 belirlenen tarihte tahliye etmedi\u011fini gerek\u00e7e g\u00f6stererek \u0130stanbul \u0130cra Dairesinde 14.09.2022 tarihinde\u00a0icra takibi ba\u015flatt\u0131.\u00a0<\/p>\n<p><strong>K\u0130RACI: \u2018T\u00dcRK\u00c7E B\u0130LM\u0130YORUM, TAAHH\u00dcTNAME H\u0130LEL\u0130\u2019\u00a0<\/strong><\/p>\n<p>\u0130ngiliz kirac\u0131 tahliye taahh\u00fctnamesine itiraz ederek icra takibini durdurdu. T\u00fcrk\u00e7e bilmedi\u011fini, \u0130ngilizceyi ana dili gibi bildi\u011fini ve noterde taahh\u00fctnamenin neden yap\u0131ld\u0131\u011f\u0131n\u0131 anlamad\u0131\u011f\u0131n\u0131 gerek\u00e7e g\u00f6stererek taahh\u00fctnamenin hileli oldu\u011funu \u00f6ne s\u00fcrerek itiraz etti.\u00a0<\/p>\n<p><strong>K\u0130RACI: \u2018AVUKATIM BEN\u0130 BIRAKTI\u2019\u00a0<\/strong><\/p>\n<p>Bunun \u00fczerine ev sahibi 11.04.2023 tarihinde\u00a0itiraz\u0131n iptali davas\u0131 a\u00e7t\u0131. Kirac\u0131 mahkemede, \u2018Dava dilek\u00e7esi bana tebli\u011f edildi, ancak benim savunma hakk\u0131m var. Ev sahibinin s\u00fcre\u00e7 i\u00e7erisinde bir avukat\u0131 vard\u0131 ama benim avukat\u0131m beni dava s\u00fcrecinde b\u0131rakt\u0131. Bana icra takibi yap\u0131lmad\u0131\u2019 dedi. Kirac\u0131, davan\u0131n reddine karar verilmesi gerekti\u011fini s\u00f6yledi.\u00a0<\/p>\n<p>Yap\u0131lan yarg\u0131lamada bu davan\u0131n tahliye taahh\u00fcd\u00fcne dayal\u0131 olarak a\u00e7\u0131ld\u0131\u011f\u0131, icra takibine yap\u0131lan itiraz\u0131n da iptali talep edildi\u011fi g\u00f6r\u00fclmektedir. Dosyada s\u00f6zle\u015fme tarihi 01.09.2021 tarihidir ve 1 y\u0131l s\u00fcreli olarak yap\u0131lm\u0131\u015ft\u0131r. 11.09.2022 tarihinde kirac\u0131, evi tahliye edece\u011fi konusunda taahh\u00fctname vermi\u015ftir.\u00a0<\/p>\n<p><strong>YEREL MAHKEMEDEN TAHL\u0130YE KARARI\u00a0<\/strong><\/p>\n<p>Yerel mahkeme burada yap\u0131lan t\u00fcm tebligatlar\u0131n do\u011fru oldu\u011funu, herhangi bir ayk\u0131r\u0131l\u0131k bulunmad\u0131\u011f\u0131n\u0131 beyan etti ve kirac\u0131n\u0131n tahliyesine karar verdi.<\/p>\n<p><strong>K\u0130RACI KARARA \u0130T\u0130RAZ ETT\u0130, DAVA \u0130ST\u0130NAFA G\u0130TT\u0130\u00a0<\/strong><\/p>\n<p>Sonras\u0131nda kirac\u0131 itiraz ederek yarg\u0131lamay\u0131 istinaf mahkemesine ta\u015f\u0131d\u0131. Mahkeme dosyay\u0131 \u015fu \u015fekilde inceledi: \u201cTebligatlar\u0131n ikincisinin isim ve imzadan imtina eden kom\u015funun beyan\u0131na g\u00f6re muhatab\u0131n d\u0131\u015far\u0131 gitmesi sebebiyle muhtara tebli\u011f edildi\u011fi \u015ferhi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bundan dolay\u0131 muhatab\u0131n d\u0131\u015far\u0131da oldu\u011funu beyan eden kom\u015funun isminin mazbataya yaz\u0131lmas\u0131 zorunlu oldu\u011fu halde kom\u015funun kim oldu\u011fu belirtilmedi\u011finden bu tebligat usuls\u00fczd\u00fcr\u201d dedi.\u00a0<\/p>\n<p><strong>\u0130ST\u0130NAF MAHKEMES\u0130: \u2018TEBL\u0130GAT USULS\u00dcZ VER\u0130LD\u0130\u2019\u00a0<\/strong><\/p>\n<p>Ev sahibi itiraz\u0131n iptali davas\u0131nda kirac\u0131n\u0131n avukat\u0131n\u0131n dosyadan \u00e7ekilmesi sebebiyle kirac\u0131n\u0131n MERN\u0130S adresi de bulunamad\u0131\u011f\u0131ndan \u0130l G\u00f6\u00e7 \u0130daresi\u2019nde olan adresine bir tebligat g\u00f6nderdi. Fakat bu tebligat kirac\u0131n\u0131n kom\u015fusuna teslim edildi. \u0130stinaf mahkemesi kom\u015fuya b\u0131rak\u0131lan tebligatta kom\u015funun isim soy isim bilgilerinin a\u00e7\u0131k\u00e7a yaz\u0131lmas\u0131 gerekti\u011fine karar vererek yerel mahkemelerin karar\u0131n\u0131 bozdu. \u0130stinaf mahkemesi karar\u0131 31.12.2025 tarihinde verildi.\u00a0<\/p>\n<p><strong>YEREL MAHKEME: KOM\u015eUYA BIRAKILAN TEBL\u0130GAT \u0130\u00c7\u0130N KOM\u015eUNUN \u0130S\u0130M VE SOY \u0130SM\u0130 YAZILMALI\u00a0<\/strong><\/p>\n<p>\u0130stinaf mahkemesi tahliyenin do\u011fru oldu\u011funu s\u00f6yledi. Burada usul kural\u0131 eksikli\u011finden s\u00f6z edebiliriz. Yerel mahkeme bir tebligat\u0131n usuls\u00fcz olarak yap\u0131lmas\u0131 ve kom\u015fuya da b\u0131rak\u0131lmas\u0131 halinde kom\u015funun isim ve soy ismi bilgisinin yaz\u0131lmas\u0131 gerekti\u011fine karar verdi. Bunun d\u00fczeltilmesi i\u00e7in yerel mahkemeye dosyay\u0131 g\u00f6nderdi.\u00a0<\/p>\n<p><strong>\u2018YABANCI K\u0130RACILAR DAVAYI UZATMAK \u0130\u00c7\u0130N BUNU KULLANIYOR\u2019\u00a0<\/strong><\/p>\n<p>Yabanc\u0131 olan kirac\u0131larda tebligat yap\u0131lmas\u0131 konusu \u00f6nemlidir. Kendilerinin MERN\u0130S adresi olmad\u0131\u011f\u0131ndan yabanc\u0131 \u015fubeden al\u0131nan adresleri oldu\u011fundan burada tebligat problemi ya\u015fanmaktad\u0131r. Bunun \u00f6n\u00fcne ge\u00e7ilmesi i\u00e7in mutlaka ev sahiplerinin kiralama yapmas\u0131 a\u015famas\u0131nda ger\u00e7ek adreslerinin tespit edilmesi i\u00e7in bir avukata vekalet vermeleri kendilerini ilerleyen s\u00fcre\u00e7te koruyacakt\u0131r.<\/p>\n<p>Taahh\u00fctname noterden al\u0131nm\u0131\u015f olsa bile bu tarz itiraz durumlar\u0131 ile kar\u015f\u0131 kar\u015f\u0131ya kal\u0131nd\u0131\u011f\u0131nda yabanc\u0131 kirac\u0131lar dava s\u00fcrecini uzatmak i\u00e7in bu yolu kullanmaktad\u0131r.\u00a0<\/p>\n<p>Burada istinaf mahkemesi yerel mahkemeye dosyay\u0131 iade etti.
