{"id":66972,"date":"2024-07-19T14:48:06","date_gmt":"2024-07-19T14:48:06","guid":{"rendered":"https:\/\/kamucalisani.net\/?p=66972"},"modified":"2024-07-19T14:48:06","modified_gmt":"2024-07-19T14:48:06","slug":"rekabet-kurumundan-rocheye-sorusturma","status":"publish","type":"post","link":"https:\/\/kamucalisani.net\/index.php\/2024\/07\/19\/rekabet-kurumundan-rocheye-sorusturma\/","title":{"rendered":"Rekabet Kurumu&#8217;ndan Roche&#8217;ye soru\u015fturma"},"content":{"rendered":"<p><p>Rekabet Kurumu, sosyal medya hesab\u0131 \u00fczerinden ila\u00e7 firmas\u0131 Roche hakk\u0131nda Ankara B\u00f6lge \u0130dare Mahkemesi&#8217;nin karar\u0131 \u00fczerine Rekabeti Koruma Kanunu&#8217;nun ihlal edilip edilmedi\u011finin tespiti i\u00e7in soru\u015fturma a\u00e7\u0131ld\u0131\u011f\u0131n\u0131 duyurdu.<\/p>\n<p>Rekabet Kurumu&#8217;ndan yap\u0131lan a\u00e7\u0131klamada \u015f\u00f6yle denildi:<\/p>\n<p>Rekabet Kurulunun, Roche M\u00fcstahzarlar\u0131 Sanayi A\u015e\u2019nin 4054 say\u0131l\u0131 Rekabetin Korunmas\u0131 Hakk\u0131nda Kanun\u2019u ihlal etti\u011fi iddias\u0131na y\u00f6nelik olarak yap\u0131lan \u00f6nara\u015ft\u0131rma sonucunda al\u0131nan 25.02.2021 tarihli ve 21-10\/130-55 say\u0131l\u0131 karar\u0131, Ankara B\u00f6lge \u0130dare Mahkemesi 8. \u0130dari Dava Dairesinin 21.03.2024 tarihli ve 2023\/1084 E., 2024\/663 K. say\u0131l\u0131 karar\u0131 ile iptal edilmi\u015ftir.<\/p>\n<p>Mahkemenin iptal karar\u0131 \u00fczerine, dosyada yer alan bilgileri ve belgeleri 21.05.2024 tarihli toplant\u0131s\u0131nda m\u00fczakere eden Kurul, s\u00f6z konusu Mahkeme karar\u0131n\u0131n gere\u011finin yerine getirilmesini teminen, 4054 say\u0131l\u0131 Kanun\u2019un ihlal edilip edilmedi\u011finin tespiti amac\u0131yla Roche M\u00fcstahzarlar\u0131 Sanayi A\u015e hakk\u0131nda soru\u015fturma a\u00e7\u0131lmas\u0131na 24-23\/534-M say\u0131 ile karar vermi\u015ftir.<\/p>\n<p>Rekabet Kurulu taraf\u0131ndan al\u0131nan soru\u015fturma kararlar\u0131, hakk\u0131nda soru\u015fturma a\u00e7\u0131lan te\u015febb\u00fcs ya da te\u015febb\u00fcs birliklerine karar\u0131n tebli\u011f edilmesini takiben kamuoyunun bilgisine sunulur.
