Ev sahibi ve kirac\u0131lar aras\u0131ndaki anla\u015fmazl\u0131klar\u0131n artaca\u011f\u0131n\u0131 belirten uzmanlar bu durumun uzun s\u00fcre devam edece\u011fi, normale d\u00f6nmenin zaman alaca\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcn\u00fc payla\u015f\u0131yor.<\/p>\n<p>2022 y\u0131l\u0131nda ba\u015flayan ve 2023 y\u0131l\u0131nda da uzat\u0131lan kira art\u0131\u015f\u0131nda y\u00fczde 25 zam s\u0131n\u0131r\u0131 yasas\u0131 1 Temmuz itibariyle sona eriyor. Ge\u00e7en 2 y\u0131lda ev sahibi ve kirac\u0131 aras\u0131nda \u00f6nemli \u00f6l\u00e7\u00fcde anla\u015fmazl\u0131k ya\u015fatan bu durumun t\u0131rmanaca\u011f\u0131n\u0131 ifade eden Gayrimenkul ve Yat\u0131r\u0131m Uzman\u0131 Hasan Ceran, uyu\u015fmazl\u0131klar\u0131n ve hukuki davalar\u0131n artaca\u011f\u0131 bilgisini verdi.<\/p>\n<p>Ceran \u015fu bilgileri verdi: \u201c\u0130\u015f yerleri i\u00e7in bir de\u011fi\u015fiklik s\u00f6z konusu de\u011fil ancak konutlarda ciddi bir kaos ya\u015fan\u0131yor ve durum uzun s\u00fcre devam edecek gibi g\u00f6r\u00fcn\u00fcyor. Ancak ortada birtak\u0131m \u00e7\u00f6z\u00fclemeyen durumlar \u00e7\u0131kabiliyor; \u00f6rne\u011fin ev sahibi son iki y\u0131ld\u0131r kira ar\u0131\u015f\u0131nda y\u00fczde 25 oran\u0131n\u0131 ge\u00e7mediyse 10 bin liraya kiraya verdi\u011fi ve bug\u00fcn yakla\u015f\u0131k 15 bin olan miktar\u0131 enflasyon oran\u0131n\u0131n y\u00fczde 65 a\u00e7\u0131kland\u0131\u011f\u0131n\u0131 farz edersek 25 bin TL civar\u0131nda bir rakama \u00e7\u0131karacak. Benzer konutlar\u0131n kiralar\u0131n\u0131n \u00e7ok daha y\u00fcksek olu\u015funu g\u00f6sterip bu rakam\u0131 d\u00fc\u015f\u00fck bulurken kirac\u0131 taraf\u0131nda ise bir anda y\u00fcksek bir art\u0131\u015f olarak g\u00f6r\u00fclecek. Uyu\u015fmazl\u0131klar artarken hukuki s\u00fcre\u00e7ler devreye girecek. Burada da hem ev sahiplerinin hem de kirac\u0131lar\u0131n hukuki haklar\u0131n\u0131 bilmesi b\u00fcy\u00fck \u00f6nem ta\u015f\u0131yor.\u201d<\/p>\n<p><strong>K\u0130RA UYARLAMA DAVASI YA DA K\u0130RA TESP\u0130T DAVALARI ARTACAK <\/strong><\/p>\n<p>Ya\u015fanan ve ya\u015fanacak olan bu karma\u015fa i\u00e7erisinde arabulucu, uzla\u015ft\u0131r\u0131c\u0131 gibi \u00e7\u00f6z\u00fcm yollar\u0131 ile sonuca gidilemedi\u011fi takdirde kira uyarlama davas\u0131 ya da kira tespit davalar\u0131n\u0131n a\u00e7\u0131labilece\u011fi bilgisini veren Ceran baz\u0131 \u00f6nemli hususlara da dikkat \u00e7ekti:<\/p>\n<p>\u201cYeni d\u00fczenleme ile 5 y\u0131l\u0131n\u0131 doldurmayan kirac\u0131lar i\u00e7in ya\u015fanan anla\u015fmazl\u0131klarda kira tespit davas\u0131 de\u011fil, kira uyarlama davas\u0131 yoluna gidebilir. S\u00f6zle\u015fme yap\u0131ld\u0131\u011f\u0131 s\u0131rada taraflarca \u00f6ng\u00f6r\u00fclmeyen ola\u011fan\u00fcst\u00fc bir durum ya\u015fanmas\u0131 halinde uyarlama davas\u0131na gidilebiliyor. Enflasyon, salg\u0131n hastal\u0131k, d\u00f6viz kuru, deprem gibi durumlar buna dahildir. Bununla birlikte, kira kontrat\u0131n\u0131n 5 y\u0131l\u0131 doldurmas\u0131 halinde, yap\u0131lan art\u0131\u015f\u0131 az bulan m\u00fclk sahibi ya da art\u0131\u015f\u0131 y\u00fcksek bulan kirac\u0131 da kira tespit davas\u0131 a\u00e7abilir.<\/p>\n<p>T\u00dcFE oran\u0131n\u0131n \u00fczerinde bir zam s\u00f6z konusu oldu\u011funda haks\u0131z kira art\u0131\u015f durumu nedeniyle sebepsiz zenginle\u015fme h\u00fck\u00fcmlerine g\u00f6re istihkak davas\u0131 a\u00e7\u0131labilir, ev sahibinin T\u00dcFE oran\u0131nda zam yapmas\u0131 ve kirac\u0131n\u0131n \u00f6deme yapmamas\u0131 durumunda ise kirac\u0131n\u0131n tahliyesi talep edilebilece\u011fi gibi icra yoluna da gidilebilir. B\u00f6yle bir durumda da bor\u00e7luya alacak ve tahliye talepli \u00f6deme emri g\u00f6nderilir, kirac\u0131n\u0131n 7 g\u00fcn i\u00e7inde itirazda bulunmamas\u0131 halinde ve 30 g\u00fcn i\u00e7inde borcunu \u00f6dememesi durumunda icra m\u00fcd\u00fcrl\u00fc\u011f\u00fc kanal\u0131 ile tahliyeye gidilir.\u201d<\/p>\n<p><strong>HANG\u0130 DURUMLARDA TAHL\u0130YE GER\u00c7EKLE\u015e\u0130R? <\/strong><\/p>\n<p>Tahliye ko\u015fullar\u0131na da de\u011finen Hasan Ceran, konut kiras\u0131n\u0131n \u00e7evredekilere g\u00f6re d\u00fc\u015f\u00fck kalmas\u0131 halinde kira uyarlamas\u0131 davas\u0131 a\u00e7\u0131lm\u0131\u015f ise ve yeni belirlenen kiran\u0131n kirac\u0131 taraf\u0131ndan kabul edilmedi\u011fi durumda kirac\u0131n\u0131n \u00e7\u0131kart\u0131labilece\u011fini, kira s\u00fcresi 11 y\u0131l\u0131 doldurdu ise ev sahibinin kirac\u0131 s\u00f6zle\u015fmesini yenilememe hakk\u0131na sahip oldu\u011funu bildirdi. Bununla birlikte kira kontrat\u0131nda belirlenen maddelerden birinin ihlali, ev sahibinin birinci derece yak\u0131n\u0131n\u0131n konut ihtiyac\u0131, evin tadilata al\u0131nmas\u0131 ya da sat\u0131lmas\u0131 halinde yeni malikin gereksinim sebebiyle tahliyesini istemesi, kirac\u0131n\u0131n tahliye taahh\u00fcd\u00fc imzalamas\u0131, kira \u00f6denmedi\u011fi ve ihtarname \u00e7ekilmesine ra\u011fmen 30 g\u00fcnl\u00fck ihtar s\u00fcresinde \u00f6deme yap\u0131lmamas\u0131, kirac\u0131n\u0131n oturdu\u011fu konuta zarar veren davran\u0131\u015flar i\u00e7inde olmas\u0131 gibi durumlar\u0131n da tahliye sebebi olabilece\u011fini belirtti.<\/p>\n<p><strong>K\u0130RADA Y\u00dcZDE 25 SINIRININ KALKMASI MEVCUT DAVALARA YANSIMAYACAK <\/strong><\/p>\n<p>Y\u00fczde 25 kira zam s\u0131n\u0131r\u0131n\u0131n kalkmas\u0131 ile ilgili a\u00e7\u0131klamalarda bulunan Avukat Arabulucu Umut Metin, \u2018\u2018Mevcut kira tespit davalar\u0131n\u0131n y\u00fczde 25 d\u00fczenlemesi ile herhangi bir ba\u011f\u0131 bulunmamaktad\u0131r. 1 Temmuz sonras\u0131 y\u00fczde 25 zam s\u0131n\u0131rlamas\u0131n\u0131n kalkaca\u011f\u0131 bildirilmi\u015fti. Yeni d\u00f6nemde T\u00dcFE oranlar\u0131na g\u00f6re zam yap\u0131lacakt\u0131r. M\u00fclk sahipleri taraf\u0131ndan istenilen oran kadar zam yap\u0131labilecek alg\u0131s\u0131 olmamal\u0131. 1 Temmuz sonras\u0131 yenilenecek kira s\u00f6zle\u015fmelerinde zam oran\u0131 son 12 ay\u0131n T\u00dcFE rakamlar\u0131 baz al\u0131narak yap\u0131lacakt\u0131r. Ge\u00e7mi\u015f 2 y\u0131lda y\u00fczde 25 zam yap\u0131ld\u0131ysa yeni d\u00f6nemde ge\u00e7mi\u015f 2 y\u0131ldaki farklar\u0131 da T\u00dcFE rakamlar\u0131na ekleyerek zam yap\u0131lamaz\u2019\u2019 dedi.<\/p>\n<p><strong>\u201cYEN\u0130 K\u0130RA S\u00d6ZLE\u015eMELER\u0130 MAKS\u0130MUM SON 12 YILLIK T\u00dcFE ORTALAMASINA G\u00d6RE YAPILIR\u201d <\/strong><\/p>\n<p>Kira zam oranlar\u0131n\u0131n son 12 ayl\u0131k enflasyon ortalamas\u0131n\u0131n \u00fcst\u00fcnde olamayaca\u011f\u0131n\u0131 belirten Metin, \u2018\u2018Yeni kira s\u00f6zle\u015fmeleri maksimum son 12 y\u0131ll\u0131k T\u00dcFE ortalamas\u0131na g\u00f6re yap\u0131l\u0131r. S\u00f6zle\u015fmelerde farkl\u0131 zam oranlar\u0131nda anla\u015f\u0131lm\u0131\u015f olabilir. B\u00f6yle durumlarda da s\u00f6zle\u015fmedeki zam oran\u0131 T\u00dcFE\u2019nin alt\u0131ndaysa anla\u015f\u0131lan s\u00f6zle\u015fmedeki oran ge\u00e7erlidir. E\u011fer s\u00f6zle\u015fmedeki oran T\u00dcFE\u2019nin \u00fcst\u00fcne \u00e7\u0131km\u0131\u015fsa T\u00dcFE oranlar\u0131 ge\u00e7erlidir\u2019\u2019 diye konu\u015ftu.<\/p>\n<p><strong>\u201cGE\u00c7M\u0130\u015eE D\u00d6N\u00dcK K\u0130RA FARKI M\u00dcLK SAH\u0130B\u0130NE \u00d6DEN\u0130R\u201d <\/strong><\/p>\n<p>Metin, kira tespit davalar\u0131nda hakimin h\u00fckmetti\u011fi kira bedelinin ge\u00e7mi\u015fe d\u00f6n\u00fck fark\u0131n\u0131n kirac\u0131 taraf\u0131ndan m\u00fclk sahibine \u00f6denece\u011fini s\u00f6yledi. Metin, \u2018\u2018Kira tespit davalar\u0131 oldu\u011funda davalar uzun s\u00fcrebiliyor. Kira tespit davalar\u0131, hakim taraf\u0131ndan m\u00fclk\u00fcn emsallerine g\u00f6re fiyat\u0131n\u0131n belirlenmesidir. Taraflar dava \u00f6ncesi arabulucu ile anla\u015famad\u0131ysa dava s\u00fcrecinde hakimin karar\u0131 beklenir.
